Talking with Neal Katyal about the Solicitor General's Office: Arguments, Policies, and Political Influence
The Supreme Court regularly calls for the views of the Solicitor General on cases pending certiorari. Those views, delivered on behalf of the federal government, have a significant impact both procedurally and substantively on the Court's decisions. Understanding how the Solicitor General's views are sought, formulated, and delivered, is thus an important part of Supreme Court practice, and offers key insights into the development of the law and the views of the Department of Justice. Perhaps no attorney in the country is better positioned to peel back the layers of this process than the prolific Supreme Court advocate and former Acting Solicitor General Neal Katyal. The Patents Committee of the New York City Bar Association presents a conversation with Neal Katyal on the arguments, policies, and political influence (if any) on the Solicitor General's views at the Supreme Court, with a special focus on patents.
